　　Introduction to the Addition of Foreign-related Commercial Cases under Jurisdiction of the primary People’s Court of Nanjing Jiangbei New Area

　　一、增设涉外商事案件管辖权的背景和依据

　　Ⅰ. Background and basis on the addition of court jurisdiction over foreign-related commercial cases

　　为充分发挥审判职能作用，更好地服务保障南京江北新区和中国（江苏）自由贸易试验区南京片区发展建设，平等保护中外民商事主体合法权益，积极营造良好的营商环境，推进对外开放合作平台建设，南京江北新区人民法院从履职之初就层报最高人民法院增设涉外商事案件管辖权。

　　In order to fully present the functioning role of adjudication, better serve and ensure the development and construction of Nanjing Jiangbei New Area, as well as of Nanjing Division of China (Jiangsu) Pilot Free Trade Zone, equally protect the statutory rights and interests of civil and commercial subjects, actively foster a sound business enabling environment, and promote the construction of opening-up and cooperation platform, the Nanjing Jiangbei New Area Primary People’s Court reported the addition to the Supreme People’s Court of P.R.C at the outset of court’s functioning.

　　2021年底，最高人民法院（2021）最高法民他271号批复、江苏省高级人民法院苏高法〔2021〕186号批复，指定南京江北新区人民法院管辖南京江北地区范围内的第一审涉外商事案件。昨天，南京市中级人民法院发布宁中法〔2022〕35号公告，南京江北新区人民法院于2022年3月1日开始管辖涉外商事案件。

　　At the end of 2021, the Supreme People’s Court of P.R.C Approval (2021) SPC Civil Affair No. 271 and the Jiangsu Provincial High People’s Court Approval 〔2021〕JPHPC No. 186 authorized Nanjing Jiangbei New Area Primary People’s Court the trial jurisdiction over foreign-related commercial cases in Nanjing Jiangbei New Area. Yesterday, the Nanjing Intermediate People’s Court made NIC Announcement〔2022〕No.35 that Nanjing Jiangbei New Area Primary People’s Court would enforce jurisdiction over foreign-related commercial cases starting from March 1, 2022.

 

　　二、案件管辖的范围

　　根据上级法院的批复，南京江北新区人民法院依法管辖发生在南京江北新区范围内诉讼标的在2000万元以下（不含本数）的第一审涉外商事案件（不含申请承认和执行外国法院商事判决、裁定；承认和执行外国仲裁裁决；确认仲裁协议效力；申请撤销、不予执行仲裁裁决案件）。

　　In accordance with the approvals of higher courts, the Nanjing Jiangbei New Area Primary People’s Court enforces the first-instance trial jurisdiction over the foreign-related commercial proceeding of which amount is less than 20 million yuan (excluding 20 million yuan) in Nanjing Jiangbei New Area (excluding actions of requesting recognition and enforcement regarding judgements and rulings of commercial cases made by foreign courts, recognition and enforcement of foreign arbitral awards; confirmation of effect of arbitration agreements; revoking and not setting aside arbitral awards.) 

　　对南京江北新区人民法院作出的第一审涉外商事案件判决或者裁定，当事人不服提起上诉的，由南京市中级人民法院受理。

　　Appeals of first-instance judgements and rulings of foreign related commercial cases made by the court shall be heard by the Nanjing Intermediate People’s Court.

　　

　　三、所做准备工作

　　涉外商事审判担负着维护国家主权，服务扩大对外开放的重要职能。新区法院学习借鉴先进地区经验，从提高司法服务能力、建立健全工作机制、推动专业人才培养等方面，促进涉外审判体系与审判能力现代化。

　　Foreign-related commercial trials play an important role in safeguarding national sovereignty and serving the expansion of openness. Nanjing Jiangbei New Area Primary People’s Court learns experiences from advanced regions, promoting the modernization of foreign-related trial system and capacity in terms of improving judicial service ability, establishing and improving work mechanism, and advancing professional training.

　　一是设立专门审判机构。

　　Firstly, Establishing the specialized trail institution.

　　经省委编办批复成立全省首个自由贸易区法庭，以“地域+类型”的特殊管辖改革精准服务保障营商环境。

　　The first Free Trade Zone court of Jiangsu approved by Provincial Commission Office for Public Sector Reform is going to provide accurate services to preserve the business enabling environment by this special "region + type" jurisdiction reform.

　　二是建立专项司法协作机制。

　　Secondly, creating specialized judicial cooperation mechanism.

　　与上海浦东新区法院自贸区法庭、上海市青浦区法院进博会法庭等长三角地区涉外审判机构开展交流合作，共同推进制度创新、服务国家战略，共享智慧法院建设成果，高起点谋划、高标准推进涉外商事审判工作布局。

　　We have built a communication and collaboration platform with foreign-related courts located in Yangtze River Delta, including the Free Trade Zone Tribunal of Shanghai Pudong New District Court, the Expo Tribunal of Shanghai Qingpu Court, jointly promoting system innovation, serving the national strategy, sharing the construction achievements of smart courts, and advancing the layout of foreign-related commercial trials from a high starting point and standards.

　　三是把专业化摆在突出位置。

　　Thirdly, Putting Professionalization in a Prominent Position.

　　组建涉外商事专业合议庭，选派干警至南京中院跟班办案学习，优选商事审判经验丰富、外语水平较高、调研能力较强的法官组成合议庭，同时，配备具备英语专业八级水平证书的干警从事审判辅助工作。

　　Establishing specialized collegial panel for foreign-related business, selecting judges and assistants to learn from Nanjing Intermediate People's court. Judges with the competence of rich commercial trial experience, high level of foreign language and strong research ability would be qualified to form collegial panel. Judge assistants qualified with TEM-8 certificate will be equipped to assist them in the trial.

　　四是强化调查研究。

　　Fourthly, Strengthening Investigation and Research.

　　开展江苏自由贸易试验区国际商事争议多元化解平台的创新构建研究、自贸区商事改革司法服务保障问题研究，参与省法院关于司法服务保障自贸区建设创新机制专题调研，形成调研报告3份，典型案例被全面依法治省委员会评选为“全省法治市场建设优秀实例”，中共南京市委全面深化改革委员会办公室在《南京改革》内刊2022年第2期刊发南京自贸区法庭在涉外商事审判领域改革探索经验。

　　We’ve carried out research on constructing an alternative dispute resolution platform of international commercial disputes, and on issues in respects to the judicial service guarantee of commercial reform in Jiangsu Pilot Free Trade Zone. We have completed three research reports after participating in the specific research organized by Jiangsu High Court on “Innovative Mechanism Concerning Judicial Service Safeguarding The Construction of Free Trade Zone”. Our typical cases were also awarded “Excellent Practices on the Construction of Provincial Law-based Market” by the Provincial Comprehensive Law-based Governance Commission. Moreover, our experience on the reform of foreign-related commercial trial was introduced in the second edition of “Nanjing Reform” Internal Journal in 2022 by the Comprehensive Deepening Reform Commission of the CPC Nanjing Municipal Committee.

　　下一步，我们将坚持以习近平新时代中国特色社会主义思想为指导，深入学习贯彻习近平法治思想，全面贯彻党的十九届六中全会和省第十四次党代会精神，扛起“争当表率，争做示范，走在前列”重大使命，以承接涉外商事案件管辖为契机，切实加强涉外商事审判队伍专业化建设，不断提升司法效能，为全方位高水平对外开放提供更加坚强有力的司法服务保障。

　　Hereafter, we will continue to persistently follow the guidance of Xi Jinping's Thought on Socialism with Chinese Characteristics for a New Era, thoroughly study and implement Xi Jinping's Thought on the Rule of Law, fully conduct the spirit of the Sixth Plenary Session of the 19th Central Committee of the CPC and the 14th Provincial Congress of the Communist Party of China, undertake the major mission of “striving to set an example, striving to be an model, striving to be at the forefront”. By taking the opportunity of jurisdiction over foreign-related commercial cases, we will strengthen effectively the professional construction of foreign-related commercial trial team, continuously improve judicial efficiency in order to guarantee a stronger judicial service for the all-round and high-level opening up policy.

　　一是坚持党的绝对领导，确保涉外商事审判工作正确政治方向。

　　Firstly, adhering to the absolute leadership of the Communist Party and ensure the correct political direction of foreign-related commercial trials.

　　认真学习贯彻习近平法治思想，深刻领会“坚持统筹推进国内法治和涉外法治”重要论述，从讲政治、讲党性的高度，在思想上、认识上、行动上，把“两个确立”落到实处，坚持党对涉外商事审判工作的绝对领导。

　　We are ought to seriously learn and implement Xi Jinping’s Thought on the Rule of Law, deeply understand the significant statement of “adhering to coordinate domestic rule of law and foreign-related rule of law”, implement effectively the “two establishments” in terms of thoughts, cognition and action from the substantial perspective of politics and Party spirit , and adhere to the Party’s absolute leadership on foreign-related commercial trials.

　　二是增强大局意识，服务保障自贸试验区南京片区高质量发展。

　　Secondly, enhancing awareness of thinking in big-picture, serving and ensuring the high-quality development of Nanjing Pilot Free Trade Zone.

　　坚持国家战略部署到哪里，法院的司法服务和保障就延伸到哪里，运用法治思维主动研判大局，服务保障自贸试验区南京片区高质量发展。服务保障高质量推进“一带一路”交汇点建设，建立与行业协会、政府主管部门沟通协调机制，打造国际商事纠纷解决优选地。

　　We insist that the judicial services and guarantees of the court should be extended to the place where the national strategy is deployed, and assess situation proactively by the rule of law so as to better serve and ensure the high-quality development of Nanjing pilot free trade zone. We commit to serve and ensure the high-quality promotion on construction of the intersection of the Belt and Road Initiative, establish a communication and coordination mechanism with industry associations and government departments, creating a preferred place for international commercial dispute resolution.

　　三是创新工作机制，构建与高水平开放相适应的涉外商事审判机制。

　　Thirdly, innovating work mechanism, structuring a foreign-related commercial trial system suitable for high-level openness.

　　同仲裁机构、调解组织共同研究建立一体运行合作机制，完善定期联系、案件移交、协调互助、调解对接、信息通报、交流研讨等制度，实现纠纷前端治理，畅通诉与非诉衔接渠道。突出专业化、国际化、类型化导向，聚合专业涉外调解资源。研究国际商事调解的特点和规律，制定调解规则及职业道德规范，建立调解工作流程及诉前调解的配套机制，实现涉外商事调解工作制度化、规范化。

　　We are going to research and establish an integrated operation and cooperation mechanism with arbitration institutions and mediation organizations, improving the system of regular communication, case removal, coordination, mediation assistance, information sharing, exchange and discussion to explore pre-litigation dispute resolution and unlock the channels between litigation and non-litigation. We will emphasize the characteristic of specialization, internationalization and typology, gather professional resources with regard to foreign-related mediation, study the features and rules of international commercial mediation, make regulations on mediation and professional ethics. Furthermore, establish a mediation workflow and a supporting system for pre-litigation mediation to achieve the institutionalization and standardization on foreign-related commercial settlement.

　　四是坚持精品战略，擦亮自贸区法庭涉外商事审判品牌。

　　Fourthly, adhering to the high-quality strategy, characterizing the foreign-related commercial trial of the Free Trade Zone Court as a reputable brand.

　　注重审理好涉及国际条约、确认新型商业规则，行业影响广、社会关注度高的涉外商事案件，在重大法律问题上作出有影响力，经得起检验的精品判决。建立精品案例、典型作法报送机制，清单化管理，系统化培育，精细化打磨，以过硬的精品审判质量提升公信力和影响力。

　　We focus on the trial of foreign-related commercial cases concerning international treaties, new commercial regulations, or cases with wide influence on industry and society, and make influential and high-quality judgements on major legal issues. We are going to establish a reporting system of high-quality cases and typical practices, manage them in an inventory approach, cultivate them in a systematical way, tailor them in a precise manner, and finally promote our public credibility and influence through high-quality trial.
